Right of withdrawal for services

When does this notice apply?
This notice applies to consumers entering into distance or off-premises contracts for paintwork and vehicle repairs. It does not grant an additional right of withdrawal to business customers or for ordinary contracts concluded at our workshop.
Discussed in person, accepted digitally later
If we discuss and negotiate the specific work with you in person at our workshop and you later accept the corresponding quotation by email or digitally, that alone does not make the agreement a distance contract. The actual negotiations matter, not just how you later give your acceptance.
An inspection, a general enquiry or dropping off your vehicle does not automatically meet this condition. If the specific work is subsequently negotiated and agreed entirely remotely, the agreement may be a distance contract with a statutory right of withdrawal. Later delivery of the vehicle does not remove an existing right of withdrawal.
Agreeing an individual colour or specification does not automatically exclude the statutory right of withdrawal for work on your existing vehicle. The exception for goods made to a customer’s specifications is a separate matter.
If you want the work to start sooner
If you have a statutory right of withdrawal and want the work to begin before the period ends, you can separately and expressly request and consent to an early start. You also acknowledge that your right of withdrawal will be lost once we have fully performed the service. These declarations are voluntary and relate to your specific order; accepting a quotation alone does not replace them.
You receive the withdrawal notice and model form before making your declaration. You can sign the declaration or send it expressly by email. Starting work alone does not end the right of withdrawal; if you withdraw, proportionate payment for services already performed may be due where the statutory conditions are met.
Your right of withdrawal
You have the right to withdraw from this contract within 14 days without giving a reason. The withdrawal period is 14 days from the date the contract is concluded. It does not begin before you have been properly informed of your right of withdrawal.

To meet the deadline, it is sufficient to send your withdrawal statement before the withdrawal period expires.
Effects of withdrawal
If you withdraw, we will reimburse all payments received from you, including any delivery costs, except additional costs arising from your choice of a delivery method other than our least expensive standard delivery. We will reimburse you without undue delay and no later than 14 days after receiving your withdrawal statement.
We will use the same payment method you used for the original transaction unless we have expressly agreed otherwise. You will not incur any reimbursement fees.
If you expressly requested that we begin work during the withdrawal period and the statutory conditions for compensation are met, you must pay a reasonable amount for the services provided up to your withdrawal. This is proportionate to the work already completed compared with the full agreed scope. The agreed total price is generally the basis; if it is disproportionately high, the market value applies.
Early expiry of the right of withdrawal
For a paid service contract, your right of withdrawal expires once we have fully performed the service, provided you expressly consented before work began to performance during the withdrawal period and acknowledged that your right would expire upon full performance. For off-premises contracts, you must provide this consent on a durable medium. Merely starting work does not extinguish the right.

If you wish to withdraw from the contract, you may complete this form and send it to us. Its use is optional; any other clear withdrawal statement is also sufficient.
